where in the constitution does it give government the right to force anyone to buy or use a particualar service? This is exactly what is happening as this health care bill makes everyone buy health insurance or be penalized. they have taken control of our purse strings and now they want to control our lives.

Not only is Nancy Pelosi out of the loop on the Constitution, but so is Harry Reid. When he talked about the health care bill, he said something to the effect that the three basic rights are life, liberty, and the freedom from want. WHOOPS!! the third one is the pursuit of happiness. Harry Reid and the rest of the Democratic party needs to get with the picture.

http://www.healthcarereform.homestead.com -

Individual mandates to carry health insurance and other aspects of national health care reform are unconstitutional. Article I, Section 8 does not authorize Congress to implement a health insurance mandate or universal health care plan; Congress should be talking about a constitutional amendment under Article V.

For a comprehensive list of articles, commentary and video on this subject, including individual comments from members of Congress, please visit the referenced website (no advertising, no solicitation, just a commitment to constitution principles.)

For all the reasons listed in this article, FRC should NOT support the Stupak amendment or others like it. The health care monstrosity cannot be improved or made acceptable by amendments. That's because it was never intended to be a 'health care reform' plan; it's main purpose is to impose a socialist form of government on our nation. All the Stupak amendment does is give cover to Dems who want to support the bill anyway, but are fearful of their pro-life constituents. Mark my words, the final product will (or will eventually) permit government funding of abortion, although the Dem leadership will continue to play the 'now you see it, now you don't' game until the end. By supporting Stupak, FRC and other pro-life groups are put in the position of acquiesing to 'reform' if the amendment is included. We should withdraw support for Stupak-like efforts and force our Congressional representatives to vote on a bill that plainly includes abortion funding. This is the only way this socialist effort has a chance of failing.

How is it that the Federal Government can tax the people within the states and then say to the states: If you want your money back, you have to do what we say even if we don't have the constitutional power to tell you. Now that the States are enabled because of their dependence on Federal money because only the Feds can print money and not live within their means, unlike the States, businesses, citizens and anyone else you can think of has to. What's going on is unquestionably unconstitutional! No matter how much perfume you stick on the pig, it still stinks to high heaven. Americans wake up! Regardless of the party you support, reform still has to take place through legal means. If you want Health reform, do it at the State level or change the constitution. If you want the Feds paying for education, social services and a truck load of other things they pay for without having been granted that power by the SUPREME law of the land, than change the law, not the interpretation! Great article.

This law review article agrees with you on the case law side, as well.

Note that doctors and nurses are licensed on a state by state basis, and insurance is NOT bought across state lines, and each state separately regulates it. This is not an accident but our Constitution at work.
